Study on the enforcement of State aid rules by national courts of the EU Member States

On 31st July 2019, DG Competition published the Study on the enforcement of State aid rules by the national courts of the EU Member States. The study covers 766 judgements ruled in the period 2007-2017. The report represents the most comprehensive study conducted so far on this subject. The findings of the study will be taken in consideration by the European Commission in the process of revision of the 2009 Notice on the enforcement of State aid law by national courts.

The study was conducted out by a consortium, including Spark Legal Network, the Florence Competition Programme (FCP) of the European University Institute, Ecorys and Caselex. In particular, the FCP team supervised the data collection process and drafted the final report. The FCP team included Dr. Marco Botta, acting as project coordinator, Prof. Pier Luigi Parcu, Prof. Giorgio Monti, Prof. Leigh Hancher, Francesco Maria Salerno and Maria Luisa Stasi.
